Section 106 agreements (developer contributions)

Information about section 106 agreements and how to make a compliance request.

Section 106 agreements are legally binding agreements, entered into by individuals or groups (often a developer) with an interest in a piece of land. They are used to secure the delivery of on-site infrastructure or financial obligations, which will be used to fund infrastructure improvements.

On-site infrastructure that may be provided as a result of a section 106 agreement includes:

  • affordable housing
  • public open spaces and play areas
  • habitat protection
  • access roads

In West Berkshire, all eligible developments must pay towards the Community Infrastructure Levy (CIL), as well as any site-specific requirements secured through Section 106 agreements.
